Correct — $0 out of your pocket. When you buy a new construction home, the builder has a budget for agent compensation built into their pricing. Tomas negotiates that commission from the builder as part of your offer. You don't write a check to Tomas at any point. If the builder refuses to pay, Tomas discusses your options with you before proceeding.
If you've already signed in at a builder's sales office, that builder may refuse to pay a buyer's agent for that specific community — this varies by builder. However, for any builder you haven't visited yet, Tomas can still be registered as your agent. Non-exclusive means Tomas represents you specifically for the property or properties listed in the agreement — not for your entire home search. You're free to work with other agents on other properties. It's a low-commitment way to get professional representation for a specific home without locking in for your entire search.
Yes. Either you or Tomas can cancel the agreement with written notice — effective upon receipt (or as specified in the agreement). There is no cancellation fee charged to you. If Tomas was involved in showing you specific properties, he may still be entitled to compensation on those specific homes during a brief continuation period after cancellation.
The builder's sales rep works for the builder — it's literally their job to protect the builder's interests, not yours. They may prefer you come unrepresented so there's no agent negotiating against them on your behalf. Having Tomas represent you doesn't cost the builder more (the commission is built into the price either way) — it just means someone is negotiating hard for you on upgrades, lot premiums, and closing cost credits.
Builders have a lot of flexibility they don't advertise. Tomas can negotiate: free or discounted upgrades (flooring, countertops, appliances), closing cost credits, lot premium reductions on less desirable lots, rate buy-down contributions, and contract addenda that protect you. He also reviews all builder contracts before you sign, attends walkthroughs, and advocates for you if punch-list items aren't completed. The builder's rep cannot do any of this for you.
